Terms and Conditions of GOZUGA TRAVEL VOYAGER & VOYAGER ONE

1. Introduction

These Terms and Conditions (“Terms”) govern the use of all travel and real estate services provided under the brands GOZUGA TRAVEL VOYAGER (“VOYAGER”) and VOYAGER ONE, operated by GRUPO GOZUGA S.A.S. (“we,” “our,” or “the Company”).

VOYAGER focuses on unique travel and cultural experiences, while VOYAGER ONE specializes in international real estate exploration, advisory, and retirement-oriented investment opportunities. Together, these services are designed to create enriching journeys that combine present enjoyment with future possibilities.

By accessing or using our services, websites, applications, or booking systems, you agree to comply with these Terms.

2. Scope of Services
 

1. VOYAGER – Travel Experiences

   • Curated tours, cultural activities, culinary experiences, local immersion, and private or group travel itineraries.

   • Services include but are not limited to bookings of accommodations, transportation, guides, and event participation.

2. VOYAGER ONE – Real Estate & Investment Journeys

   • Real estate viewing trips, property showcases, senior retirement community presentations, and investment-related travel experiences.

   • All real estate information provided is for informational and exploratory purposes only and does not constitute financial, legal, or investment advice.

3. Combined Experiences

   • Certain itineraries may include both travel enjoyment and exposure to potential retirement/investment properties.

   • Participants acknowledge that investment decisions remain solely their responsibility.
      

3. User Eligibility

• Our services are open to individuals worldwide, with particular operations in the United States, Colombia, and Mexico.

• Senior Customers: Given that many of our clients are senior citizens, we commit to ensuring accessibility, clarity of information, and safe travel conditions. However, participants are responsible for confirming their own physical readiness and obtaining any required medical clearance before travel.

• Users must be of legal age in their country of residence to enter into binding contracts.
   

4. Compliance With Local Laws

• United States: Services are subject to U.S. federal, state, and consumer protection laws, as well as privacy regulations.

• Colombia: Services operate under Colombian commercial law, consumer protection frameworks, and tourism regulations (including Ley General de Turismo).

• Mexico: Services comply with Mexican consumer law, tourism regulations, and applicable investment restrictions.

• Users agree to comply with all local laws of the countries where they participate in experiences or explore real estate opportunities.
   

5. Bookings, Payments, and Refunds

• All bookings must be confirmed through authorized VOYAGER channels.

• Payments are processed securely through approved payment gateways.

• Refunds, cancellations, or itinerary changes are subject to our Cancellation and Refund Policy provided at the time of booking.

• GRUPO GOZUGA S.A.S. is not responsible for delays or cancellations caused by third parties, natural events, or government restrictions.
   

6. Third-Party Partners and Affiliates

• VOYAGER & VOYAGER ONE collaborate with affiliates, travel partners, local guides, real estate developers, hotels, and transportation providers.

• While carefully selected, these third parties operate independently.

• GRUPO GOZUGA S.A.S., VOYAGER, and VOYAGER ONE shall not be held liable for any acts, omissions, negligence, or non-compliance by affiliates or partners.
   

7. Travel Risks and Responsibilities

• Travel inherently involves risks including but not limited to transportation delays, accidents, illness, force majeure events, or unforeseen restrictions.

• Participants assume full responsibility for personal safety, insurance coverage, and compliance with travel requirements such as visas, health certificates, and vaccinations.
   

8. Real Estate Disclaimer

• VOYAGER ONE provides property viewing opportunities, guided site tours, and informational presentations.

• The Company does not guarantee property values, future investment performance, or legal outcomes.

• Users are strongly advised to seek independent legal, tax, and financial advice before making any property-related decisions.

9. Privacy Policy
 

• We respect the privacy of all users and comply with international standards of data protection including:

  • GDPR (Europe, if applicable)

  • CCPA (California, USA)

  • Habeas Data & Colombian privacy regulations

  • Mexican Federal Law on the Protection of Personal Data

• Personal data collected (e.g., for bookings, inquiries, or marketing) will only be used in accordance with our Privacy Policy and never sold to unauthorized parties.
   

10. Intellectual Property

• All content, logos, designs, and materials of VOYAGER and VOYAGER ONE are intellectual property of GRUPO GOZUGA S.A.S. and may not be reproduced without permission.
   

11. Limitation of Liability

• To the fullest extent permitted by law, GRUPO GOZUGA S.A.S. shall not be liable for:

  • Indirect or consequential losses.

  • Actions or failures of third-party partners.

  • User’s reliance on investment opportunities presented.

• Liability is limited to the value of the purchased service.
   

12. Senior Travelers’ Considerations

• While VOYAGER specializes in senior-friendly experiences, users remain responsible for assessing their own health conditions.

• Medical emergencies must be covered by personal travel insurance.

• Accessibility requests will be accommodated where possible but cannot always be guaranteed in all destinations.
   

13. Amendments
We reserve the right to amend these Terms at any time, with notice provided through our website or email.

14. Governing Law and Jurisdiction

• For services conducted in the U.S., laws of the relevant state apply.

• For services conducted in Colombia, Colombian law and jurisdiction of its courts apply.

• For services conducted in Mexico, Mexican law and courts apply.
   

For international operations, conflicts of law will be resolved in accordance with Colombian law, where GRUPO GOZUGA S.A.S. is incorporated.

  1. Aceptación de los Términos

• El uso de los servicios de GOZUGA TRAVEL VOYAGER (“VOYAGER”) y VOYAGER ONE implica la aceptación plena y sin reservas de los presentes Términos y Condiciones.
  
  2. Definiciones

• VOYAGER: Plataforma de viajes y experiencias locales.

• VOYAGER ONE: Plataforma de turismo inmobiliario internacional para exploración de oportunidades de retiro.

• Usuario: Toda persona natural o jurídica que acceda o utilice los servicios.

• Afiliados y Socios: Empresas colaboradoras en viajes, turismo e inversiones.
  
  3. Objeto del Contrato

• VOYAGER ofrece experiencias de viaje, turismo cultural y gastronómico.
  VOYAGER ONE facilita visitas guiadas y experiencias orientadas a la exploración de inmuebles internacionales en Colombia, México y EE. UU., principalmente para adultos mayores que evalúan opciones de retiro.
  
  4. Alcance Territorial

• Los servicios están disponibles a nivel global, con operaciones principales en Colombia, México y Estados Unidos, ajustándose a la normativa vigente en cada país.
  
  5. Limitación de Responsabilidad

• GRUPO GOZUGA S.A.S., VOYAGER y VOYAGER ONE no se hacen responsables por:

• Acciones, negligencias o incumplimientos de socios y afiliados.

• Eventos fuera de control como fuerza mayor, conflictos, pandemias o cierres de fronteras.
  
  6. Servicios de Viaje

• Incluyen:

• Reservas de hoteles y transporte.

• Experiencias locales (gastronomía, cultura, historia, naturaleza).

• Acompañamiento especializado para adultos mayores en sus viajes.
  
  7. Servicios de VOYAGER ONE (Inmobiliario)

• Visitas guiadas a inmuebles en regiones seleccionadas.

• Orientación sobre posibles inversiones para retiro.

• Integración de viajes de disfrute con la exploración de propiedades.
  
  8. Protección de Datos Personales

• Los datos de los usuarios serán tratados conforme a:

• Ley de Habeas Data (Colombia)

• GDPR (Unión Europea, si aplica)

• CCPA (California, EE. UU.)

• Normatividad mexicana en protección de datos
  
  9. Derechos del Usuario

• Los usuarios podrán:

• Acceder, rectificar o eliminar sus datos.

• Solicitar copia de la información registrada.

• Oponerse al tratamiento de datos para fines comerciales.
  
  10. Obligaciones del Usuario

• Proporcionar información veraz.

• Cumplir con requisitos de visado, seguros y documentos migratorios.

• Abstenerse de usar los servicios con fines ilícitos.
  
  11. Política para Adultos Mayores

• Dado que gran parte de nuestros clientes son personas en edad de retiro, VOYAGER y VOYAGER ONE garantizan:

• Accesibilidad en recorridos.

• Información clara y transparente sobre propiedades y viajes.

• Acompañamiento especializado.
  
  12. Propiedad Intelectual

• Las marcas GOZUGA TRAVEL VOYAGER y VOYAGER ONE son propiedad de GRUPO GOZUGA S.A.S.. Queda prohibida su reproducción o uso sin autorización.
  
  13. Relación con Afiliados y Socios

• Los afiliados y socios son independientes.
  VOYAGER y VOYAGER ONE no se hacen responsables por sus acciones, omisiones, garantías o incumplimientos.
  
  14. Legislación Aplicable

• Colombia: Código de Comercio, Estatuto del Consumidor y normas de turismo.

• México: Ley Federal de Protección al Consumidor y Ley de Turismo.

• EE. UU.: Normas federales y estatales en materia de viajes, consumidores e inversiones inmobiliarias.
  
  15. Modificaciones de los Términos
  GOZUGA se reserva el derecho de modificar estos Términos y Condiciones en cualquier momento.
  Los cambios entrarán en vigencia desde su publicación en los canales oficiales.
